Terms of Service

Last Updated: 10/18/2026

1. Introduction

Welcome to LeadPointe.com. These Terms of Service (“Terms”) govern your access to and use of LeadPointe’s website, products, and services (“Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our Services.

LeadPointe, LLC (“LeadPointe,” “we,” “us,” or “our”) reserves the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this website and updating the “Last Updated” date. Your continued use of our Services after such modifications constitutes your acceptance of the revised Terms.

2. Services Description

LeadPointe provides a cloud-based website, lead management, and marketing platform designed for small service-based businesses. Our Services may include, but are not limited to:

  • Website building and hosting, including custom domains
  • Website content, such as pages and blog posts, drafted with artificial intelligence (“AI”) for your review and approval
  • Forms and lead capture tools
  • Contact, lead, job, and task management
  • Email and SMS notifications
  • Website statistics, reporting, and performance analytics
  • Marketing tools, including ad tracking, campaigns, and email and SMS content

Features change over time. Your plan includes the features described on our website for that plan when you use the Services.

3. Accounts and Users

3.1 Account Creation

To access certain features of our Services, you may be required to create an account. When you create an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

3.3 Users

The account owner may add other people, such as staff, as users of the account. Each person must have their own login; logins may not be shared. The account owner is responsible for the actions of every user they add, and for removing users who should no longer have access.

3.4 Authorized Partners

LeadPointe works with partners, such as web designers, developers, and agencies, who may build and manage websites and marketing for their clients on LeadPointe. A partner may work in your account only if you authorize it, and you may revoke that authorization at any time in your account settings. While authorized, a partner and its staff may act in your account on your behalf within the access you grant, and you are responsible for their actions in your account as you are for your own users. We keep a record of actions taken in your account, including by partners, and you can review it.

Emails, texts, and AI actions used by an authorized partner in your account count against your plan’s allowances and any extra usage you have purchased, in the same way as your own use.

If you came to LeadPointe through a partner, that partner remains associated with your account for referral purposes whether or not it has access to your account. A partner’s own compensation and obligations are governed by a separate partner agreement between the partner and LeadPointe.

4. User Responsibilities

4.1 Acceptable Use

When using our Services, you agree to:

  • Comply with all applicable laws and regulations
  • Respect the intellectual property rights of others
  • Provide accurate and truthful information
  • Use the Services only for lawful purposes

4.2 Prohibited Activities

You agree not to engage in any of the following activities:

  • Use the Services in any manner that could damage, disable, overburden, or impair our servers or networks
  • Attempt to gain unauthorized access to any part of the Services
  • Use automated means, including scraping, to access or collect data from our Services
  • Use the Services for any illegal or unauthorized purpose
  • Harass, abuse, or harm another person
  • Submit false or misleading information
  • Violate any third-party rights, including intellectual property rights
  • Send email or text messages to people who have not given you the consent the law requires, including to purchased, rented, or scraped lists
  • Publish content that is false, misleading, or makes claims about your business, licensing, pricing, or reviews that are not true

4.3 Your Customers and the Messages You Send

You are responsible for how you collect the information of your own customers and contacts, and for having any consent required by law, including under the Telephone Consumer Protection Act and the CAN-SPAM Act, before you use the Services to email or text them. You are responsible for honoring their requests to stop receiving messages. Messages sent from your account, whether written by you, your users, an authorized partner, or AI and approved by you or by a setting you chose, are sent on your behalf.

5. Plans, Billing, and Payment

5.1 Plans and Fees

Our plans, their monthly prices, their monthly allowances of emails, texts, and AI actions, and the one-time launch package fee are described on our Pricing page or in a separate agreement. All fees are quoted in U.S. dollars and do not include taxes, which are your responsibility where they apply.

5.2 Billing

The launch package fee is billed when you sign up. Subscription fees are billed monthly on the first day of each month. Your first monthly bill is prorated from the day you sign up.

5.3 Allowances and Extra Usage

Your plan’s monthly allowances reset each billing month and do not carry over. You may purchase extra usage at any time, and you may choose to have extra usage purchased automatically, up to a monthly limit you set. Purchased extra usage does not expire while your account is open. If your allowances and extra usage run out, sending email and text messages and AI actions pause until your allowances reset or you purchase more. Your website stays online while your account is in good standing.

5.4 Changing Plans

You may change your plan at any time. The new plan takes effect with your next monthly bill.

5.5 Payment Methods

We accept payment via credit card, bank transfer, or other methods as specified. By providing payment information, you represent that you are authorized to use the payment method and agree to pay all fees at the rates then in effect.

5.6 Late Payments

For late payments, we may charge interest at the rate of 1.5% per month (or the maximum rate permitted by law, if less) on all overdue amounts.

5.7 Refunds

Except as provided in Section 6, fees are non-refundable.

5.8 Failed Payments

If a payment fails, we will try your payment method again on the 3rd and the 7th of the month and let you know each time. If the payment still fails on the 7th, your account is paused: the account owner can sign in only to update the payment method, and sending email and text messages, AI actions, and calls and texts to any phone number we provide for your account stop. Your website stays online. When you update your payment method, we charge the amount owed right away and everything is turned back on.

If the amount owed is still unpaid at the end of that month, your website is also taken offline. If it is still unpaid at the end of the following month, your account is closed as described in Section 13.3. We do not bill new monthly fees while your account is paused. If you dispute a charge with your card issuer, we may pause your account in the same way until the dispute is resolved.

6. 30-Day Money-Back Guarantee

If you cancel within 30 days of your website going live, or within 45 days of signup if your website has not gone live, whichever comes first, LeadPointe will refund your launch package fee and your first monthly subscription payment. To request a refund, contact us by phone or email. Upon refund, your account will be closed and your website taken offline. Messaging and AI usage allowances are not refundable separately, and add-on purchases made during this period are not covered by this guarantee.

7. Websites, Domains, and AI-Generated Content

7.1 Your Website

While your account is open and in good standing, we host your website as part of the Services. Your website’s content belongs to you (Section 8.3). The LeadPointe platform, including its themes, templates, layouts, and software, belongs to us and is licensed to you for use with the Services while your account is open.

7.2 Domains

If you connect your own domain name, you remain its owner and are responsible for registering and renewing it with your domain registrar. We may also provide an address on a LeadPointe domain while your account is open.

7.3 AI-Generated Content

Some content in the Services, such as pages, blog posts, and messages, may be drafted with AI provided by third-party AI services, using the information you give us about your business. AI drafts can contain mistakes. You are responsible for reviewing content before you approve or publish it, and for the accuracy of what appears on your website and in your messages. Content you approve is your User Content. We do not guarantee any particular search ranking, number of leads, or business result.

7.4 AI-Generated Images

The Services can create images with AI, using third-party AI services, from a description you write or choose (“AI Images”). Creating an AI Image uses extra usage, as shown before you create it.

Using AI Images. You may use AI Images created in your account for your business, including on your website, in emails and text messages, in ads, and on social media. As between you and LeadPointe, AI Images you create are your User Content (Section 8.3). AI Images are not exclusive: the AI service may produce the same or similar images for others, and images in any shared library we provide may be used by other businesses. Copyright may not protect AI-generated images, so you may not be able to stop others from using similar images.

People in AI Images. AI Images show fictional people unless you add your own photos. You may add a photo of a real person only if that person is you, or has given you permission to use their photo and likeness this way, and you confirm this each time. You may not use the Services to create an image of any other real, identifiable person, to imitate anyone’s face, voice, or likeness without their permission, or to show anyone in a false, embarrassing, or harmful way. We keep a record of the photos you add and your confirmation.

Photos you add. Photos you add are sent to our AI image provider to make the image and are kept in your image library. Only add photos you have the right to use.

Presenting AI Images honestly. An AI Image is not a photo of something that happened. Do not use one in a review, testimonial, or before-and-after comparison, or to show work, results, or customers you did not actually have. Where the law requires it, label AI Images as created or altered by AI.

Keep their markings. Do not remove or alter any watermark, content credential, or other information in an AI Image’s file that shows it was made by AI.

Your responsibility. You are responsible for how you use AI Images and for making sure your use is lawful and not misleading. Neither LeadPointe nor its AI providers guarantee that an AI Image is accurate, original, or free of third-party rights. We may remove an AI Image, or turn off image creation for your account, if it is used in a way that breaks these Terms.

8. Intellectual Property Rights

8.1 Our Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof, are owned by LeadPointe, our licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.

8.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal or internal business purposes.

8.3 User Content

You retain ownership of any content you submit to our Services or approve for publication (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with providing our Services.

9. Data Privacy and Your Customers’ Data

Your use of our Services is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand our practices regarding your personal information.

Information about your own customers and contacts, and about visitors to the website we host for you, is your data. We process it on your behalf to provide the Services, and we do not sell it or use it for our own marketing.

If you connect a service you use, such as QuickBooks Online, you confirm that you are allowed to connect that account. Your use of that service remains subject to its own terms. We use the access you give us only as described in our Privacy Policy, and you can disconnect it at any time.

10. SMS and Text Messaging

10.1 Program Description

LeadPointe Notifications is a text message program that sends SMS notifications to registered users of the LeadPointe platform (business owners and their staff), including alerts for new leads, task assignments, job updates, and appointment reminders.

10.2 Consent

You can opt in by checking the optional SMS consent box when you set up your account at leadpointe.com/getting-started, or by turning on SMS notifications in your account settings. The consent box is unchecked by default. By opting in, you consent to receive text messages from LeadPointe at the mobile number you provide. Consent is not a condition of purchase or use of the Services.

10.3 Message Frequency

Message frequency varies based on your account activity and notification preferences.

10.4 Rates

Message and data rates may apply. You are responsible for any fees charged by your mobile carrier.

10.5 Opt-Out

You may opt out of SMS notifications at any time by replying STOP to any message or by updating your notification preferences at crm.leadpointe.com/crm/notification-preferences. After opting out, you will receive one confirmation message and no further SMS messages will be sent.

10.6 Help

Reply HELP to any message for assistance, or contact us at info@leadpointe.com or 303.489.7484.

10.7 Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

10.8 Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. For more information, see our Privacy Policy.

11. Limitation of Liability

11.1 Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LEADPOINTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST SIX MONTHS.

12. Indemnification

You agree to defend, indemnify, and hold harmless LeadPointe, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your use of the Services, or messages sent and content published from your account.

13. Termination

13.1 Termination by You

The account owner may cancel your account at any time on the Billing page of your account, or by contacting us by phone or email. Cancellation takes effect at the end of the billing month in which you cancel, unless you cancel under the 30-Day Money-Back Guarantee in Section 6. Until then your account keeps working, you will not be billed again, and you can change your mind on the Billing page.

13.2 Termination by Us

We may terminate or suspend your access to all or part of the Services, without prior notice or liability, for any reason, including, without limitation, if we believe that you have violated these Terms.

13.3 Effect of Termination

When your account closes, your right to use the Services ends and your website is taken offline. Any phone numbers we provided for your account are released and cannot be recovered, and any custom domain is disconnected from our service; your domain itself stays yours. Before your account closes, you may ask us for a copy of your website content and contacts. We keep your account’s data for 90 days after it closes in case you return, and then delete it as described in our Privacy Policy. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to these Terms or the Services shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The place of arbitration shall be Westminster, Colorado. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LeadPointe regarding the Services.

15.2 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

15.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

15.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.
